Default Insurance claim?

This is half a gear-grinder, but I have an insurance question as well..

I got rear-ended in my shiny new truck about a week ago.

Very minor damage (at least on my end). Her bumper cracked the plastic cover for my trailer electrical connection. I went to Ford the next day and replaced it - $110.

I called her to let her know, she said that she is going through insurance and that I would have to put a claim in with my insurer (who would pass it along to her insurer).

I wanted to know if this would count as a "claim" against my "claims free" history? Seems completely ridiculous to lose my discount because some stupid broad was texting and hit me from behind. Especially over $110 in damage.

Anyone know for sure??

Not if she's at fault, which she is if she rear ended you.

If she hit you from behind and its her fault you can go fill out a police report to cover your butt. Cease all contact with her and if her insurance company calls give them the police file number and they will figure it out.

You don't even need to let your insurance company know.

If the only damage is what you say (ensure there is not hidden damage) you can deal directly with her insurance company. They may want you to get an appraisal, which isn't a bad thing.


If you know her insurance company and policy number give them a call and ask to speak to whoever is handling the claim under that policy.

When I got rear ended and went to file a police report: the cop said they won't even look at it unless there's more than $2k damage.

Not at fault claims CAN affect your premium.

And this one drives me nuts......

First off, claims don't get any smaller than the one you just described. This girl is beyond dumb if she wants her insurer to pay for this one. Really really dumb.

Back to my original point....look at your policies closely. Some now include "claims free discount" This can be removed in the event of ANY claim, regardless of who's at fault.

This is different than your premium being affected because an at fault claims has resulted in your driving record be adjusted.

Most don't do this but certainly worth keeping an eye out for.

Yes, that is exactly what I am concerned about.

She is making a claim because the damage to her vehicle is significantly more than mine. I'm not sure how much more, but I presume she figured it was worthwhile to submit a claim.

Right...duh...Monday's.

She may still be able to just file a collision claim for herself to get her car fixed leaving you out of the equation but still flip you some $ for your damages.

Call your broker or take a look at your policy. A claims free discount should be easy to spot. If you are with an insurer that doesn't bother with that (more likely than not) then you have nothing to worry about.
