i would imagine that for a cruise ship, yes. you are responsible for the passengers, crew, ship, etc. on most cruise lines the captain is the second highest paid person on ship, first being the cruise director. i guess it is no different than being charged with leaving scene of crime and vehicular manslaugher, if your car hit some one on the street and you ran away.
apparently, there was not a call for 'mayday' until they were well into the evacuation procedures. that does not work in favour of the captain. also, the location of the ship in relation to land.
judging by the photos, the ship is clearly too close to land. the area around the ship is not equipped to dock a ship of that size. generally, if a cruise ship were to use an area like that as a port of call, it would 'dock' far away from land and have tender boats carry passengers to and from land.
if the ship was having problems, they are suppose to stop, make a call and repair. i have been on a ship with electrical failure. they did just that. fortunately, they fixed what ever was wrong and we got on our way. captain made announcement of electrical failure, stopping, and the call. after the engine or generator was fixed the mayday was canceled. this happened at about 2am, so most passengers were unaware of the situation.
