Default Who's right here?

I moved into a friend's condo because she moved in with her boyfriend. She had a cat, the condo is pet friendly. She said she would not allow us to get a pet because if she had to move back in to the condo, her cat would freak out because of the smell from another animal.

About two months later, we were having our housewarming and my wife brought up that she really really wanted one, and my landlord/friend was totally into it and saying ya, give'er!

She is now engaged to her boyfriend, and they are going to likely sell the condo and his house and get a new house.

Now she's saying, no that was not part of our agreement to have pets, and we are not allowed one.

WTF! My wife has totally fallen in love with a kitten in the mean time, and was super excited that we could get one! Plus the landlord is never moving back in here!

We should totally be able to have a cat, right? I think so. Take my side.

Of course you should be able... Sounds like your friend is a bit of a b--...bag and I would get the cat, enjoy the cat and find a new friend... It takes a lot to legally boot you from a rented property so I'd say live your life... But that's me

Sorry dude, it sucks because she's your friend, but if the original agreement was for no pets, and you have no evidence (other than your word) you're probably SOL.

Too bad your friend isn't willing to accomodate.
If there were witnesses to the friend/landlord telling his wife that it was ok for them to get a pet, then would it then be ok? Could it then be considered a legally binding agreement or whatever terminology I should have used?

Everytime she brings it up just say you're trying to find a home and then go on with your life.

So you don't have the kitten yet?

If not, can't you wait until you move? Pets are great and all but to get a pet at the cost of a friendship doesn't make a whole lot of sense. Just wait until you move and get a different kitten. She'll love other kittens too. They're kittens. Hard to hate them.

She's the landlord, so unless you have it in writing she has the final say. I can totally understand someone not wanting a cat in a place they are trying to sell, especially a kitten.

Takes a whole lot more than that to leaglly kick some "friend" out of a rent situation... Tell her to stuff it!! Plus she would never know anyway... and really, isn't going to do a damn thing about it

She is "right" in that she can dictate the terms of the rental agreement, but she is also a ###### bag.

First off, my wife sent her these pics and now she has said she'll provide us written permission, so...

WE WIN!!!!

I didn't realise this when I made the thread.

As for the verbal agreement/get it in writing stuff... we have nothing in writing. We pay rent as cash. We have a very casual agreement, because her boyfriend is my wife's 2nd cousin. So basically we just trust them because they are family.

So seeing as it was all a verbal agreement, i think it stands that she said yes. Not only that, about 4 other people were a part of the convo.

It doesn't matter now anyways because WE WIN but ya.

Not true, unless there are written rules and restrictions in the lease regarding pet ownership (or in condo by-laws) then the landlord does not have the final say.

The critical question here is 'Was this written into the original lease/rental agreement.'

If not, the default position is that you can have whatever pet you want but you remain responsible for any damage that the pet does.

If it was in writing, I would be hesitant to advise that you can rely on a verbal modification (When she later said yeah go ahead) and since this would likely be classified as a waiver of her rights to refuse permission for a pet, the waiver can also be revoked and the original written term of the lease reinstated, which has pretty clearly happened here.

So again, was the pet restriction in writing in the original lease or not?

Just get the cat and forego the damage deposit if neccessary to keep the peace. That's what that money is for - she can use it to have the place deep cleaned after you leave if its that big an issue.

Flip has a point.

If the first agreement was in writing, then you have to abide by that.


But! If both "agreements" were verbal, Then I'd say the last agreement stands!



IMO, Your Friend/LandLord needs to "Man-Up!" and accept the fact that She said it was OK for you to go ahead with getting the kitten. If She persists then it sounds like you are going to be between a rock and a hard place (LandLord and Wife) and you'll probably lose a "Friend".

You should defend your Wife and her desire to have a pet. You'll be moving out anyway, It won't be any skin off your nose and there is probably not much she can do anyway because it's a pet friendly condo and she had a cat in there before you moved in.


BTW: "Friend/LandLord" ...... She's acting Bi-Polar!!

hey cats of any kind are awesome, what's not to like having a miniature tiger in the house? plus dogs are needy and whiny, i'd rather have a pet that can take care of itself if i'm not around for a few days
