intent.
The average Joe who has
a few drinks after work probably isn't going to kill someone, but if he gets loaded and drives, then he does intend to put other people's lives at risk. If I did something while knowing that it would risk your life and you died from it, that's enough intent for me to deserve some severe punishment.
