As you remember, the agreement states: "Applications must be originally written in Objective-C, C, C++, or JavaScript as executed by the iPhone OS WebKit engine" (and of course HTML and CSS are cool), so PhoneGap -- which indeed sticks to HTML, CSS and Javascript -- is totally safe.
