The prosecutor cannot because they been the policy set by Alberta Justices don't allow it anymore, demerit points and fines are set by the Alberta Transportation Board which I believe derives it authority from the Alberta Traffic Safety Act. This means the Judge has the right to specify what is an appropriate punishment is for each case.
