The agreement you are referring to only allows most Indigenous people to cross without a government issued passport (they still need a status card, band membership card, or tribal record proving their status and identity). I doubt it protects them from being denied entry for having a criminal record. It also only applies to land crossings. If you travel by air, you still can be denied without a passport.
