Aggravated murder, one of the charges Robinson faces, is a crime eligible for the death penalty. In Utah, in order to charge a capital offence, prosecutors must show an individual intentionally or knowingly committed homicide, and that there was an aggravating factor, according to Fred Metos, a criminal defence attorney in Salt Lake City, Utah, who is not involved in the case.


"In this case… what they're claiming is that, in addition to causing the death of Mr. Kirk, [Robinson] put others in great risk of death or serious bodily injury, which is the aggravating factor," Metos said.
