Normally however, I dont think it ever really happens because they let cyclists get away with everything.
I've had a cycling enthusiast friend get caught twice and he was warned but never charged. But yeah, bikes are considered vehicles.
Despite not being licensed or insured. Kind of a weird double-standard.

Maybe they were drunk. They're on bikes. You're in a car. If you said something like they were so hammered that they were unpredictably weaving all over the road or something I'd consider that, of which however there has been no evidence mind you, but regardless of anything else he was still at fault.

I think it varies from state to state and I saw on reddit (so grain of salt needed) that in NJ it isn't illegal to ride a bicycle while impaired.
