Edit to add that I'm unsure how Penney got away fully acquitted, but the above article also doesn't contain many details on the case. I'm not sure vigilantism should go unpunished.

Daniel strangled him until he was dead. I get the fear and need for action, but at some point, you know, he wasn't a threat anymore. That point was long before "dead".
