The entire scenario is legal and per the constitution, apart from maybe the non-certification. If a state claims fraud but the claim is not proved or disproved can they refuse to certify? I guess it’s up to each state’s rules, and the constitution is clear that it is up to each state to decide its own rules for how EC rules get cast.

If things get escalated to the Supreme Court my guess is they say the certification date is what it is, the process is what it is, and as long as the states are following their own rules they won’t interfere. If it gets to that point then the Democrats have no legal leg to stand on and they have to accept the decision. I would expect massive civil disobedience though.

Unless there is proof of a conspiracy, then all bets are off.
