There are Personal and Professional issues along with Cap compliance issues, it really depends on how he wants to play this.

Well also, he scored 24 goals and 44 points for the Oilers last season which are not insignificant numbers.
If he's on LTIR then unless that scoring is replaced, expect the team to be worse. Maybe not miss-the-playoffs worse but they could end up with a lower seed and a tougher path in the playoffs.
So it seems the Oilers are between a rock and a hard place when it comes to Kane's availability.
