What I'm a bit unclear on is how he has this contract that includes the non-compete if he never got anything in writing about the promotion, pay increase, etc.? If it was in his original contract where something like leads and above had this clause kick in, then how would it kick in when HR told him there was no promotion?
The likely full story here is the company jerked him around and screwed him a bit, but his fault in the matter is not properly mentioned. Something like a 75% screw job, but a 25% goof up on his side
