So a team might be out of it by November but are not officially eliminated until say Mid February. If they only win 3 games for the rest of the year they would have 6 points. Maybe they win more, but they would still be in the business of winning, so they couldn't just sell off and tank.
A team that gets eliminated 2.5 weeks before the end of the season wins 5 of 8 games having 10 points, so they would pick ahead of the above team.
There are probably still some flaws with this, but it in order to get the first pick you still have to be trying to win games. You can't just go trading your UFA's away for picks and prospects.

The biggest issue is that it would make it so much harder for a team to get out of the basement. That system might work in a league where there are no trade clauses and contracts are like 3 years max.
