And just to be clear, I would say that I agree with you- it is the driver's fault.

It's just that it's good to teach kids to look out for themselves and not to rely on other people. Just the other day I almost got smoked by a truck while I had the walk sign; he wasn't going to stop on a right turn on red. Because I was watching out for him; I avoided the collision. He slammed on his brakes and stopped about 4 feet past where I had been.

It's better to be safe than to be in ICU thinking to yourself "well, at least I was in the right."

As a driver, I watch out for kids. Many drivers don't; as the anicdotes in this thread indicate. If we can use this unfortunate incident to prevent one other kid from getting hurt; then maybe we can find some good in this very bad thing that happened.
