We're not disagreeing... your example isn't even necessary; you don't need to show that he subject matter of the regulatory regime would affect a neighbouring province for it to be within Federal purview. As I said, any argument that might be made from the Province's side is probably ultimately doomed, which is what Mbates said and he obviously knows what he's talking about here.
Outside of the constitutional law realm, though, the political reality is that some provinces simply have more leeway to ignore constitutional law based on whether the current Federal government cares about whether people there are pissed off at them.
