The point I was trying to get accross is you probably will get charged witha DUI. But drinking just before you take the test, will skew the results. Therefore, in court, you can use the defence of "I just took a drink before I took the test" (obviously in court you would be a little more professional). They wont be able to determine if it was the drink that put you over (becuase of high concentration of alchohol) or that your blood-alchohol level is actually above the legal limit.
This of course, can be eliminated with a blood test. But we are talking about breathalizers here.
