MOU said "a team's list" not "that team's list". The CBA was changed, and by letter of the CBA he would have had to, but not by letter of the MOU which is what was in place at the time.

If there was no lockout, then yes by the letter if the law he would need reentry waivers. However if there was no lockout, he would not be in Russia anyway.
The bottom line is that the lockout changed everything and the Flames made absolutely sure with the league offices. The league changed the rules temporarily because of the lockout. Flames were never in danger of losing both the picks and the player.
