By the letter of the law, yes he would have needed to clear reentry waivers. However, the language was unclear about lockouts, and the NHL lawyer gave them the all-clear before making the offer. I think it was much ado about nothing.

MOU said "a team's list" not "that team's list". The CBA was changed, and by letter of the CBA he would have had to, but not by letter of the MOU which is what was in place at the time.
