It's shady and wouldn't be able to be memorialized in writing, but I assume stuff like that happens in negotiations all the time.

Handshake deals are a really dumb thing to do when you have millions of dollars at stake. You never rely on anyone on their word. You take the written contract in cause it goes to a legal battle. No competent agent would never accept that.
