Of course it matters.
There are a lot of situations where how we get to a result is, at least to some degree, just as important as the result itself.
If we are supposed to be a country of laws, and we've decided that something should no longer be illegal, then we should strike the law making that thing illegal.
It's not like this is some massive government project that will take a lot of time and money. It's a vote in the legislature, to codify a policy that they are already following. Eliminating grey areas in laws/policing, and changing a policy, that can easily be changed/forgotten, into a law, that requires some effort to change, is intrinsically valuable, assuming you think it is good policy, which in this case I do.
