Need advice - issue with Blue Cross
Ok, here is the problem. My wife was recently put on short term disability by her doctor. She has all of the required paperwork and everything is above board. She has worked at the same job for almost 11 years now, paying just under $100 a month for Blue Cross.
AB Blue Cross denied her request for short term disability benefits because some form wasn't filled out when she started working at her current job...11 years ago. I personally spoke to the BLue Cross rep, and she is basically saying "sorry, you are SOL. If this form is not filled out, then the employee is basically opting out of the disability coverage". It turns out that the gong show HR department forgot to fill out said form for about 10 people over several months. I spoke to her HR department, and they are saying that it was my wifes responsibility to ensure all paperwork was done. They say they have a copy of a letter that was sent to her stating that this form was not filled out, but we can't remember ever seeing it.
My issue is, what the hell have we been paying for? Over 11 years, we have paid well over $10,000 for benefits that we can't use?
So the question is this: are there lawyers that specifically deal with Blue Cross disputes? Or should I be looking elsewhere?
