It was shown in Shiv's conversations with her mom that she is clearly not a loving/fit mother. She would sell them down the river for a little bit more on her end (plus, it isnt like those kids arent set for life anyway).
Given the money involved, and my thoughts on big US law, some lawyer couldve had those terms drawn up in less than an hour on a Saturday afternoon in NYC - hell, it looked like they had about 20 in the room next door.
