I don't see why not as they wouldn't be giving up confidential information by just saying "So and so refused to speak"

The reason I said Keith was that he was asked if he talked to the investigators and he said no. The implication was he wasn't asked but now I'm wondering whether he was asked and didn't respond or refused. The report actually said that there was a far larger number that simply didn't respond.
