See, I can make bad analogies too.
Maybe refusing to get vaccinated should be a crime. There was a time that drinking and driving wasn't a crime either, but the majority of society agreed that the social cost was high enough to criminalize it. There are still people out there that "see things differently" and think they should be allowed drink and drive.

The social cost of not getting vaccinated against communicable diseases is high, and for some diseases, it's high enough to warrant legal consideration.
