I'm not making excuses for the kid, but it's pretty Wild to me that it's okay to share an unidentified picture but the legal system draws the line at identifying the person .

The issue is in the photo she apparently isn't identifiable - which is why him then taking the extra step to identify her makes it much more serious.
It wouldn't be OK to share the offensive photo at all, but if she was identifiable in the image, then it wouldn't matter if he stated her name or not.
