Absolutely no doubt about it, in either scenario, as far as I’m concerned.
Within the rules or not, they held him out to gain a competitive advantage. It may not make them cheaters but it makes them even bigger pieces of #### than I already thought they were.

Actually, it does make them cheaters. The rules are clear: when a player is healthy enough to return, they have to return. Delaying the return is a direct violation of the cap circumvention rules.
