It is time that Article 3, Section 2 of the Constitution is properly invoked by Congress. The SCOTUS should only have jurisdiction for cases involving Ambassadors and where the State is a named party. All other cases should be decided by the 13 circuit courts. That would be consistent with an originalist interpretation of the Constitution and should gain overwhelming support from Kavanaugh, Gorsuch, Thomas, ACB and Alito (although their support would not be necessary as they would not have jurisdiction to hear the case)

As much crap as kavanaugh deserves for his freshman level concurrence on the Wisconsin ruling he was technically correct. The laws of Wisconsin do not allow votes to be counted if not received in time. The far right legislature saw fit to make accommodations for covid so a lower court judge did based on common sense. But it doesn’t change the law as far as the SOC is concerned unfortunately.

Take comfort though that while the SOC will enforce laws they won’t change then. Unless there’s a law somewhere that stops vote counting at midnight they at least can’t do that. We hope.
