Honestly speaking, I think this is more in between fatigue and distracted driving. Not a DUI.

How is this not worse than distracted driving? He's purposely taking all attention off the road. It's also not fatigue. This wasn't someone driving after a long shift. He purposely put his seat back and lost consciousness while in control of a motor vehicle. On top of that he was speeding.
It's much closer to criminal negligence (and probably is) than distracted driving.
