Assuming the rules for this expansion draft are the same as Vegas, the Flames can't officially request that Lucic waive his NMC for the draft until sometime early next year. The actual date will probably depend on when/if the 2020-21 season starts, but it will be sometime prior to the 2021 trade deadline.

Until then, all they can have is a handshake agreement that he'll waive it. Based on everything Treliving has said since the trade, I have no doubt that they have made such a handshake deal.
