I think the fact that it's Minnesota is a factor, what I'm seeing on Twitter from some legal folk is that it would have only been a manslaughter charge everywhere else but I guess the line is blurry between 3rd degree and manslaughter. I feel like a 2nd degree charge (that would have no chance) would be an appeasement charge.
