Apple should have renamed the product to iTalk or iMobile or somesuch rather than walk into this lawsuit. So Apple is stupid to continue using iPhone while Cisco is unethical for bargaining in bad faith.

This whole thing is dumb because cleary iPhone by Cisco is clearly jumping on the bandwagon of products that start with i, which was started by Apple with the iPod. It would be interesting if Apple could have a countersuit against Crisco for using the likeness of the name.
