Apple has been in negotiations with Cisco for ages to get rights to the name so Cisco knew Apple wanted it. One month before Apple is about to announce their phone, Cisco releases a product under the name iPhone. To me, it looks like Cisco POSITIONED themselves such that they could sue Apple. They negotiated with Apple to sell them the name WHILE developing a product under that name.
Apple should have renamed the product to iTalk or iMobile or somesuch rather than walk into this lawsuit. So Apple is stupid to continue using iPhone while Cisco is unethical for bargaining in bad faith.
