I think they have some way to deal with that type of situation in the current CBA. As you pointed out above, LTIR still didn't help the Flames then. If you really want to keep LTIR, make any overages apply to the next year's cap. This will help in emergencies, but stop teams from cheating the cap. Also, players on LTIR should not be eligible for a trade.
