There is no way they are within code for that side yard, and its likely because they didn't get the proper development permit (different from a building permit). There is so little room between the house and the fence I'm not sure how they would ever do maintenance on the exterior?
Phone these guys up and complain and you can probably get this stopped in its tracks, plus they'll be forced to fix it on their own dime. This is exactly the sort of situation the appeal board is there for, when people just ignore the rules and think they can get away with it.
