That seems weird to me.
As I understand, it's related to the reasonable expectation of something being private. Wearing a short skirt where anyone can see your legs negates the reasonable expectation that your legs are private, and therefore can be photographed. Same with the rest of you, when you are out in public.

While you may be wearing the short skirt however, you would still reasonably expect that everything inside that skirt would remain private. Pointing a camera UP your skirt to take photos is an invasion of that privacy.
