There is an odd number of council members (provided that everyone is there) so, if the vote is tied going into the mayor's last vote, then his vote will break the tie, but simply because his vote is last.

If someone is missing, and the vote is tied (including the mayor's vote), then the Mayor's vote doesn't count double or anything. A tied vote is automatically lost.
