Sure he is probably guilty, but it seems to me that this is good policy in this situation.
If the guy is convicted he's fired.
If he's found innocent, he can return to work and isn't punished financially for something he didn't do.
The former is much more likely in almost all cases, including this one, but for the rare case where the latter is true, this policy probably saves a whole lot more money and effort than it causes.
