The case summary is even worse.
The Accused’s assault was unprovoked.
The Victim was unarmed.
The Accused ignored the Victims’s attempts to verbally defuse the situation.
The Accused did not assault the Victim until the only other occupant of the bathroom had left the location. As a result, the Victim was alone and isolated when he was assaulted by the Accused.
The only motivation for the assault appears to be the Accused’s perception that the Victim was a homosexual and the fact that he is of French nationality.
The Victim (should probably read as Accused) concocted a false alibi and attempted to recruit his friends as part of that false alibi.
The Accused has not demonstrated any remorse for his behaviour and has not accepted any responsibility for the injury to the Victim. The Accused remained at large from November 1, 2003 to February 3, 2004. The Accused did not turn himself in. When initially interviewed by the police, the Accused laughed about the incident. While in a cell with an undercover officer, the Accused demonstrated no remorse for the Victim’s injury.
The Accused was not remorseful after he assaulted the Victim. The Accused was not remorseful upon arrest. The Accused was not remorseful in his discussions with the undercover officer. The Accused was not remorseful with the author of the Presentence Report. In fact, the expression of any remorse is only commented upon after the Presentence Report had been issued noting the Accused’s lack of remorse. The Accused’s presentation of remorse is contrary to his words and actions following this offence. The Crown submits that the Accused’s presentation of remorse is manipulative and hollow.
The Accused has never displayed any empathy for the Victim.
The Accused has breached his conditions of release on three subsequent occasions by consuming drugs, carrying weapons, attending bars, and breaching his curfew.
The Accused continues to minimize and rationalize his assault on the Victim.

I cannot believe he only got a four year sentence for such a barbaric attack.
