The second one had Bart clearly instigate a fight after a missed hit which deserved the extra 2 mins. On the Kesler/Frolik side, it was Frolik that got things started with a slash on Kesler's wrist after the whistle. While it was dirty for Kesler to start swinging the way he did, Engelland came in as the 3rd man there which was likely another penalty.

1) Ferland didn't jump Kesler like Holzer jumped Ferland
2) I'd guess that 99% of the time, there is no instigator called for similar instances. Typically, when they are called for heat of the moment situations, the league almost always rescinds the instigator to eliminate the 1 game suspension. If the league leaves the instigator penalty, I think you'll have a pretty good idea of what they think of the Flames. To call Engellend for 3rd man would have required there to be a 2nd man in the fight and Frolik was not fighting.
