I don't think you grasp the situation.
MAF has a NMC. Which means if he doesn't waive it for the expansion draft, Pittsburgh will be forced to use their only goalie protection spot on MAF. Which means exposing Matt Murray in the expansion draft, who looks to be their franchise goaltender for the next decade.
The issue is not losing MAF in the expansion draft. In fact the Pens would probably be happy if that would happen.
The issue is losing Matt Murray.
If the Pens don't trade MAF and he won't waive for the expansion draft, then the Pens only option to keep Murray is to buyout MAF before the expansion draft and take ~$2 million cap hit for the next 4 years (which is pretty undesirable for a Stanley Cup contender).
Pittsburgh is in a vulnerable position with regards to moving MAF. The argument that they need to give up assets to move Fleury is a reasonable one.
