The GOP needs 60 votes to confirm without using the nuclear option. Using the nuclear option (aka eliminating the filibuster) makes all votes from here on out a straight up and down vote. So strategically speaking both sides probably don't want to use the nuclear option. I suspect there will be eight Dems willing to cross over, and if not then we'll see if they go nuclear.
