She was a wife who's husband cheated on her in a very public and extended way, I can't imagine what's that like so even if it is true (and from what I read it's not anywhere near as true as claimed in things like Stone's book), that gets a pass IMO.
Lots of government officials have had private servers, it wasn't illegal. The problem with the private servers isn't the private server, it's with the government just being able to go in and read personal emails whenever they feel like. Other countries have different rules, like making it illegal for the government to read personal emails on government accounts (unless during an investigation of course) for 30 years.
