Unless there is explicit evidence of ignoring team doctor recommendations, it will be tough to find the team itself liable.

Regardless of their decision to clear him at that time, or wait a little longer, this is a hockey player with significant neck injury who returned to play a professional contact sport, and is at high risk of reinjury regardless. In addition, he played a long time after clearance, suggesting that their clearance timing was not the most important factor. They may have cleared him too early, but it's a tough argument to make that they directly impacted his outcome with timing of clearance. Remember that the flames doctors also cleared him to play multiple times.
