He is attempting (appears to have succeeded) to obtain a benefit/advantage to which he might not be entitled.
It certainly isn't acting in the Utmost Good Faith. Let me put it this way, if the insurance company had a department dedicated to placing false ads to pull down the ACV on vehicles...how would that be viewed?
I might be off base, and it might not be fraud. However, had the insurance company taken the same tact with him I suspect he would have thrown his toys.
