A lot of new homes have fences though...I'm a contractor and see fences being built all the time by the builder. But yeah I didn't notice it was a brand new home so pretty sure he's not ripping down a new fence.

If there is no fence then yeah obviously they should pay but I'm not sure if they legally have to. In this tough economic market might be hard to get someone to for over a couple thousand. Several payments could be an option if money is an issue as well.
