People can make all sorts of rules and laws, but ultimately, the person who sits on the throne is the person who people allow to sit on the throne.
You could go even further with this skepticism. Why does Dany have the most legitimate claim to the throne?

Because 300 years ago her ancestors conquered Westeros by force?

I totally agree with your conclusion though. Why did Robert Baratheon have a right to the throne? because the victorious armies said he did.

Why is Jon king of the North, because the biggest armies said he is.
