No one is making up rules. Rule #28 in the NHL rulebook is broadly construed, and would include any seemingly intentional contact made by Wideman to the official that is not covered in rule #40. It states explicitly that any incident can fall under this ruling at the discretion of the commissioner.
The argument could still be made that this constitutes abuse of an official as it is broadly defined by rule #40.1: "Any player who deliberately applies physical force
in any manner against an official." But that any disciplinary measures must be taken in accordance with rule #28, supplementarily in the absence of any infractions charged during or immediately after the game.
