Not saying it's right, but it should not be a criminal offense, if the two people are in a loving, consensual relationship. However, if you pay for sex with a 16 year old girl, that's another story.

I hear you but hard for me to believe a 40 year old and a 16 year old can be in a true loving, consensual relationship.
Agree that soliciting a 16 year old is far worse.
