For my part, the intent of Subban did not seem to be as vicious as some of the plays the NHL has suspended for. That said, I've often wondered if the NHL should discuss adopting a consequence based punishment that is more in tune with common law legal principles? In an intentional tort claim, you take your victim as you find him. If he is more fragile or less fortunate than another victim, that is irrelevant and the damages you pay fit the consequences you cause.
All of that would have to be considered in the off-season, however. Now is not the time to change up the methodology for suspensions.
